Accessing our Terms of Service
1.3 Our terms of service are included in our email signature. They are also available on our website and via our social media channels. By continuing to access our website, social media, and corresponding via email, you agree to be bound by our most up to date terms and conditions.
1.4 We reserve the right to update and change these terms of service from time to time, in line with the movement of the business. If required by law, we will provide you with notice of any changes in these terms of service by posting a notice on the website and/or by posting an updated version of these terms of service; with a new effective date stated clearly.
Client Privacy and Data Protection
1.5 Client information and resources collected by Coast Creatives will be used for business, marketing, and administrative purposes only. Clients have the right to withdraw information and data at any time. If we provide you with account information such as username and password for accessibility to website hosts, social media and email domains, you must keep all information confidential. You are responsible for unauthorised access to your account or disclosure of information to a third party.

1.6 All trademarks, service marks, trade names, logos, written content, copyright and other intellectual property rights in our website and marketing resources, including social media, and its content are either owned by us or licensed to us. All such rights are protected by intellectual property laws around the world, and all rights are reserved.
1.7 Whenever you pass on any content or materials from our resources to anyone, you must acknowledge us as the authors of such content or materials (or any other authors wherever credited by us) at the time when you pass on such content or material.
Copyright: Clients
1.8 Clients will own the copyright for all material created under this agreement, and Harriet Rose Creative Ltd can sample and reuse only for marketing and advertising purposes. Materials provided to clients by Coast Creatives will only have ownership on part of the client once payment has been made in full.
Project Execution & Cancellation
1.9 Long-term projects are commissioned on an hourly basis, in line with an agreed hourly rate of pay. Use of long-term project commissions will be executed in line with an estimated project timeline, as stated prior to work commencing.
2.0 Short term projects are commissioned on a package basis, with a full quote provided in advance. If a project is cancelled following the order being confirmed and/or prior to the deposit being paid, the customer accepts that full payment is still due and should be paid in accordance with the agreed sum(s). A 50% deposit is required upon booking and deposits are non-refundable.
2.1 Project confirmation is accepted both verbally and in written form, i.e. over email correspondence.
2.2 If a project is cancelled at any point during the design process, surpassing 48 hours after initial agreement to commence the project, the amount previously agreed is non-refundable and therefore an invoice will be issued. Likewise, if a project is cancelled at any point during the build (website design/printing) process, the full project balance is payable via invoice.
2.3 Notice of cancellation should be made in writing via email, within 48 hours of project agreement & confirmation of commencement.Notice is deemed to have been received by confirmation via an email response.
2.4 Information and files retained by Coast Creatives will be returned to the Customer upon final payment for any outstanding invoices. Within this time, Coast Creatives reserves the right to ownership of these files.
Retainers & Notice Periods
2.5 Clients with a regular retainer will be provided with a contract prior to launch with specific details on their package.
2.6 A notice period of 1 month must be provided by either party terminating a weekly and/or monthly retainer or contract.
Social Media Consultancy & Management
2.7 Coast Creatives social media services will include the setting up of social media platforms such as Facebook, Instagram, Twitter, etc. where required and not already in place. This includes creating content, engagement as well as ongoing management of these platforms, but does not include administration duties such as client bookings and responding to third party client enquiries. General responses will be made from time to time, consistent with the enquiry.
2.8 Coast Creativesd shall maintain absolute confidentiality with respect to any confidential information received from the client through their social media channels. We shall not disclose any such information without obtaining client’s specific prior consent, otherwise than in compliance with statutory requirements.
2.9 Retainer invoices for all social media management will be sent on or before the 28th of
each month.
3.0 External fees occurring, such as boosting posts and social media advertisements, are not included in the monthly retainer fee. This can either be managed by the client or added to the invoice fee (in line with prior discussions)
3.1 Any dispute, difference or question arising out of this agreement shall be settled amicably between the parties, failing which the same shall be referred to arbitration under the laws of England and Wales.
3.2 This agreement is deemed to commence from the date of the first date of management, provided in advance by Coast Creatives. The agreement will be renewed thereafter every six months, unless cancelled by either party in advance.
Changes and Revisions
3.3 The price agreed at the beginning of a contract and/or commission is based on the estimated time needed to accomplish the project and/or retainer. If a client would like to change an arrangement or add anything new, a separate estimate will be provided.
Legal
3.4 Coast Creatives will always strive to be error-free, but cannot provide this as a guarantee, therefore cannot be responsible for any relevant legal and/or financial damages.
Payment Terms
3.5 Coast Creatives will invoice clients within 28 working days of completion.
3.6 Payment terms will be outlined on all invoices.
3.7 All payments are to be processed by clients within 14 days of invoice.
3.8 Payments must be made via bank transfer to the bank account stated on the invoice.
3.9 Coast Creatives reserves the right in enforce late penalty fees to any client who does not pay past a 14-day time frame. These will be an additional charge of £45.00 per day.
Non-Payment Terms
4.0 As stated in point 3.9 of payment terms, Coast Creativesreserves the right to enforce the aforementioned late penalty fee. Failure to apply such charges does not constitute a waiver of the option so to charge. This coincides with outsourcing work such as illustration, and therefore needing to pay freelancers within a fair time period.
4.1 If the client also holds a retainer or account with Coast Creatives the hosting account may be terminated without notice in the event that invoices fall into arrears. This includes the management of websites and social media platforms.
4.2 In the event that payment is not received within a maximum of 25 days, arrears will be passed to our Debt Collection Agency. Once this has taken place, Coast Creatives Ltd are not in a position to accept payment from the client Additional fees are applied by the Debt Collection Agency. Coast Creatives has no authority to revert these fees once a debt is passed over to the Debt Collection Agency.
Press Circulation Terms
4.3 Coast Creatives can circulate news stories and press releases to the media, we cannot guarantee it will be featured or published as this is down to a journalist’s discretion.
Website Design Terms
4.4 Website design quotes are based on purely design work only. Additional costs such as domains and host subscriptions (for example, Squarespace) will be discussed at quotation stage. Coast Creatives cannot accept responsibility for changes in these costs including price increases.
4.5 Additional costs may incur should the client wish to have additional add ons and plugs to the website which are not provided by the host (Squarespace, Wix or Wordpress) in its native form. All items included in design cost are listed on the Coast Creatives website under ‘Website Design’ packages. Coding costs, including plug-ins, are not included in the original quote. We can, however, support clients by discussing codes and add-ons and gather quotes accordingly.
Digital Branding Design Terms
4.6 By using Coast Creatives services, the client agrees to provide the content and material reasonably necessary to carry out the services in a timely manner, and ensure that such material is appropriately licensed, consented, permitted, and accurate in all material respects. This includes proof-reading and error-checking post digital sign-off.
4.7 Acceptance of deliverables: If the deliverables that are a result of the graphic design services are to be dispatched to a third party for printing i.e. brochures, leaflets, signage, etc., the client is responsible for all cost beyond the point of digital design. Coast Creatives will not be financially responsible for any errors made in the print process and/or deliverables beyond digital design assets.
Holiday & Annual Leave
4.8 Coast Creatives will provide clients with a minimum of 2 weeks-notice prior to annual leave or holiday longer than a 1-week period. Social media can be scheduled in advanced & retainers can be adjusted accordingly.
Governing Legislation and Law
4.9 These terms of service, including any documents they refer to, and any disputes arising from or in relation to them or any documents they refer to, whether contractual or non-contractual, shall be governed by and construed in accordance with English law.
